In this double feature session two timely topics will be presented:

MedImmune, Inc. v. Genentech, Inc. (2007) changed the landscape of patent litigation. Hear a report from the frontlines on how these changes affect declaratory judgment litigation. You will be presented with considerations for counseling clients in a post-MedImmune environment. This session will present an analysis of the issues from the plaintiff’s, defendant’s and judge’s point of view.

The United States District Court, District of Massachusetts, adopted new Local Rule 16.6, Scheduling And Procedures For Patent Cases on November 4, 2008. You will hear the court’s view of the new rule and how the Massachusetts rule differs from special patent litigation rules in other jurisdictions. You will learn what the rule means to your practice.
